Do Not Call Violations

Spam calls and other unwanted calls are something we are all familiar with. In some cases, they are a minor annoyance, but for many they reach a level of frequency that is unbearable and disruptive to everyday life. If you are receiving the calls on your cell phone they may be costing you a significant amount of cash as well. No one should have to put up with unwanted calls, even from legitimate creditors. And many of these calls come from telemarketers and others who have no business contacting you in the first place.

Do Not Call Registry
The first thing to do is get on the Do Not Call Registry. If you think you have already registered, go back and double check. The Do Not Call list is your first line of defense against unwanted calls, and you have to be on the list to have certain remedies available to you.
Registration is free. You can register both landline and cell phone numbers. It can take up to 31 days for the calls to stop. After you have been on the list for 31 days, calls from telemarketers are illegal.
There are certain types of organizations and businesses that are allowed to call you, even if you are on the Do Not Call List These include charities, political organizations, debt collectors, survey takers, and certain others. However, even those organizations and businesses are required to stop calling you if you tell them to when they call.

Handling and Documenting Unwanted Calls
- First, keep track of all unwanted calls, even if you do not answer them or recognize the phone number.
- Record the date and time of all unwanted calls.
- If they leave a message, save it. Save all the messages.
- If the information shows up on caller ID, write down the phone number and name.
- If you answer, record the name of the caller, their ID or badge number if they have one, and the name of the company they are with.
- Write down anything you can regarding the content of the call.
- If the unwanted call comes to your cell phone, keep your cell phone records for more solid documentation and a record of what these calls are costing you
Documenting unwanted calls is crucial to making them stop. Beyond documenting the calls, there are certain actions you can take to establish liability so that you can take legal action and, in some cases, receive compensation. When you receive an unwanted call from a legitimate caller, you must tell the caller not to call you again at that number in order to establish liability. If the call was improper in the first place, this is not necessary.
